It is imperative that individuals continue to follow their health care professionals' protocols. By accessing and using the services provided by Rockies Restorative Retreat, you agree to abide by the terms and conditions outlined in this agreement.

2. Acknowledgment of Responsibility

Service Fees

Rockies Restorative Retreat collects service fees from Users in consideration for the Services provided. These fees are inclusive of the costs associated with accessing and participating in the various programs, workshops, and activities offered by Rockies Restorative Retreat. Taxes may be imposed in addition to the service fees, and such taxes will be remitted to the local taxation authority by Rockies Restorative Retreat in compliance with applicable laws and regulations.

2. Payment Methods

Photography

1. Consent for Photography

During your participation in a retreat organized by Rockies Restorative Retreat, photographs or videos may be taken by participants, retreat leaders, or guides to capture moments and experiences shared during the retreat. These images may be used by Rockies Restorative Retreat in various materials, including but not limited to the official website, social media platforms (such as Facebook and Instagram), promotional materials, and marketing campaigns.

2. Usage Rights

By participating in the retreat, you agree to grant Rockies Restorative Retreat a perpetual, royalty-free, worldwide, irrevocable license to use the photographs or videos captured during the retreat for publicity and promotional purposes. This includes but is not limited to the right to reproduce, distribute, display, and create derivative works based on the images, without the need for further consent or compensation.

3. Privacy Considerations

Cancellation Policy

1. Ticket Fees and Refunds

a. All ticket fees for Rockies Restorative Retreat events are non-refundable under normal circumstances. However, we understand that emergencies and unforeseen circumstances may arise, and we will assess refund requests on a case-by-case basis. Refunds, if granted, will be subject to administrative fees and the timing of the cancellation.

b. If you need to cancel your participation in an event due to extenuating circumstances, please contact us as soon as possible to discuss your situation. We will consider factors such as the timing of the cancellation, the reason for cancellation, and any applicable administrative fees before determining if a partial refund is appropriate.

2. Third-Party Services

a. In addition to the cancellation fees specified in these conditions, cancellation of accommodations or other services booked on your behalf by Rockies Restorative Retreat may subject you to cancellation fees imposed by the applicable third-party provider. These fees are beyond our control and will be outlined in the terms and conditions of the third-party provider.

b. Rockies Restorative Retreat will make reasonable efforts to communicate any cancellation fees associated with third-party services at the time of booking. However, it is your responsibility to review and understand the terms and conditions of these services before making a reservation.

3. Exceptions

a. Rockies Restorative Retreat reserves the right to make exceptions to this cancellation policy in extenuating circumstances or for events beyond your control, such as natural disasters, medical emergencies, or travel disruptions. 4. Refund Process

a. If a refund is approved, the refund process may take several weeks to complete. Refunds will be issued using the original method of payment, unless otherwise specified. Any applicable administrative fees or third-party cancellation fees will be deducted from the refund amount.

b. Rockies Restorative Retreat will make reasonable efforts to process refunds in a timely manner, but we cannot guarantee the exact timing of the refund or the processing time of financial institutions.

Booking and Financial Terms for Guests

1. Acceptance of Booking Terms: By initiating a transaction for the booking of a retreat ticket or pass, you acknowledge and agree to be bound by all terms, conditions, regulations, and limitations imposed by the Owner and Rockies Restorative Retreat at the time of booking. These terms and conditions may include but are not limited to payment terms, cancellation policies, and liability waivers.

2. Payment Obligation: As a User booking a retreat ticket or pass, you agree to pay the total fees for the booking to Rockies Restorative Retreat. Payment may be required at the time of booking or according to the payment schedule specified in the booking terms.

3. Payment Authorization: To facilitate the booking process, Rockies Restorative Retreat reserves the right to obtain credit card verification or pre-authorization for the full amount of the booking fees. Community Conduct

As a participant in the Rockies Restorative Retreat community, you are expected to adhere to certain standards of conduct to ensure a safe and respectful environment for all members. Respect for Others: You agree to respect the rights and dignity of other participants and members of the community. Booking Procedure

Booking Process: Bookings for our retreats can be made exclusively through our website at www.rockiesrestorative.com, specifically on our Tickets page.
Confirmation Requirement: Please note that your booking is not considered confirmed until you receive a formal confirmation from us. This confirmation will be sent via email to the address provided during the booking process.
Confirmation of Booking: Your booking will be deemed accepted and definite once you have completed the payment process and received the confirmation email from Rockies Restorative Retreat. This confirmation serves as proof of your reservation.
Booking Modifications: While we strive to accommodate all bookings, please be aware that changes or modifications may occur after the initial confirmation. These changes could include adjustments to your booking details or pricing.

Retreat Itinerary Changes

At Rockies Restorative Retreat, we prioritize the safety and well-being of our clients and staff. Therefore, we reserve the right to make alterations to retreat programs and itineraries under certain circumstances, including but not limited to:

Weather Conditions: Changes may be necessary due to inclement weather that could affect the safety of participants and staff.

While we strive to maintain the integrity of our retreat programs, please note the following:

Participant Responsibility: Rockies Restorative Retreat and its partners cannot be held responsible for losses, expenses, or disruptions resulting from delays or changes to retreat itineraries. This includes but is not limited to changes in flight schedules, transportation, or accommodations due to circumstances beyond our control.
Participant Accountability: Participants are responsible for their actions and choices during the retreat. Should a participant choose not to participate in any part of the retreat itinerary, including guided sessions or activities, they acknowledge that they are not entitled to a refund for the portion of the retreat they opt out of.

Intellectual Property Rights

This Agreement acknowledges that no transfer of intellectual property owned by the Operator or third parties occurs herein. All rights, titles, and interests pertaining to such intellectual property shall remain solely with the Operator, unless otherwise stated. Trademarks, service marks, graphics, and logos utilized in conjunction with the Services are the property of the Operator or its licensors, unless expressly identified otherwise. Any additional trademarks, service marks, graphics, or logos associated with the Services may belong to third-party entities. Your utilization of the Services does not grant you any right or license to reproduce or utilize any trademarks owned by the Operator or third parties.

Limitation of Liability

Rockies Restorative Retreat may share your personal information with other carriers to the extent necessary for the delivery of products and services only. Rockies Restorative Retreat shall not accept liability for any conduct or omissions, whether negligent or otherwise, of any supplier or individual providing services in connection with any retreat session unless such individuals are employed by or under the direct control of Rockies Restorative Retreat. While reasonable care is exercised in verifying descriptions and other information provided by third-party suppliers, Rockies Restorative Retreat cannot guarantee the accuracy, completeness, or correctness of such information. Each third-party supplier remains accountable for the accuracy, completeness, and correctness of the information they provide to Rockies Restorative Retreat.

Rockies Restorative Retreat shall not be held responsible for indirect or unanticipated losses. We shall not provide compensation for any loss, cost, damage, or claim arising from:

i. Any act or omission on the part of the participant;

ii. Unavoidable acts or omissions of third parties unrelated to the provision of contracted-for services; iii. Extraordinary or unanticipated events beyond our or our suppliers' control, the consequences of which could not have been prevented despite our best efforts; or iv. Any event that neither we nor our suppliers could have foreseen or prevented, even with all due care.

Rockies Restorative Retreat is not liable for any expenses related to travel arrangements purchased separately from Rockies Restorative Retreat.

While the Services may contain links to other resources such as websites, mobile applications, etc., we do not, directly or indirectly, imply any approval, association, sponsorship, endorsement, or affiliation with any linked resource, unless specifically stated herein.
